Criminal information was filed in the district court of Logan county, charging defendant, Emmet E. Apley, with the crime of rape, alleged to have been committed on or about July 4, 1911, upon the person of one Lillian Apley, a child of defendant and under the age of sixteen years. Upon defendant’s plea of not guilty a trial was had in said county, resulting in a disagreement of the jury. Subsequently, on the state’s application, a change of venue was taken to Stutsman county, where a trial resulted in a verdict of guilty.
