Plaintiff, individually and as a shareholder of defendant Holiday Ford Sales, Inc., brings this action against the several defendants on seven (7) counts for alleged violations of the Dealers’ Day In Court Act (15 U.S.C. § 1221), various antitrust laws, breach of certain agreements and breach of fiduciary obligations attendant to those agreements. Pursuant to F.R.C.P. 13 defendants asserted a counterclaim in three (3) counts likewise charging defalcations and breach of contract. All parties have— and still are—actively engaged in lengthy and…
