This appeal of John A. Sippos, an incompetent, by his guardian, Irene Sippos, is from the trial court’s order of January 23, 1987, denying appellant’s petition to intervene as a plaintiff in this declaratory judgment action brought by Frank and Eleanor Richards against Thomas A. Trimbur, Paul J. Trimbur, Inc., and CNA Insurance Company. 1 The action has since been discontinued at the request of the Richards.
