MEMORANDUM OPINION AND ORDER
MAROVICH, District Judge.
This case comes before the court on plaintiff’s motion for summary judgment. Plaintiff Central States, Southeast and Southwest Areas Pension Fund (the “Fund”) is a multiemployer pension fund bringing a collection action against an employer who has withdrawn from the fund. Plaintiff brings this action under the authority of the Employee Retirement Income Security Act of 1974 (“ERISA”), as amended by the Multiemployer Pension Plan Amendments Act of 1980, 29 U.S.C.
