In these consolidated actions, four in number, plaintiffs challenge a regulation promulgated by the Department of Health, Education and Welfare (HEW). The four plaintiffs, all of which are Virginia corporations with their principal places of business in Richmond, Virginia, are: Humana of Virginia, Inc., doing business as St. Luke’s Hospital; St. Elizabeth’s Hospital, Inc., which owns and operates St. Elizabeth’s Hospital and leases and operates Grace Hospital; Chippenham Hospital, Inc.; and Johnston-Willis Hospital, Inc.
