Plaintiff, as assignee, sues upon a confessed judgment entered by her assignor, Jacques & Co., Inc., against defendant in the Supreme Court of Hew York *307on. April 22d, 1940, pursuant to a statement of confession dated March 20th, 1939.
Defendant’s answer consists of two defenses. The first of these is a general denial.
