State of Maryland v. Aaron Terrell Alexander No. 1, September Term 2019 Criminal Procedure – Probation – Probation Violations. A trial court has discretion, in appropriate circumstances, to dismiss a petition alleging that a defendant has violated a condition of probation without holding a hearing on the merits of the alleged violation. In this case, the Circuit Court did not abuse its discretion when it dismissed a petition alleging a technical violation of probation when the defendant had already been incarcerated for a period that exceeded the presumptive sanction for that violation.…
