This matter came before the Court without oral argument upon consideration of the Motion for Summary Judgment (Doc. 121) filed by Defendants Terrabrook Vista Lakes, LP, Terrabrook Vista Lakes GP, LLC (“Terrabrook”), Newland Communities, LLC (“Newland”) and Westerra Management, LLC (“Westerra”) (collectively, “Defendants”). Plaintiffs did not file a response. Instead, they filed a motion for relief pursuant to Fed. R. Civ.
