Reversing.
Prior to October 17,1921, tbe appellant and defendant below, 'W. O. Morris, operated a garage in the city of Bowling Green, Kentucky, and was also local agent for tbe sale of Hupmobile and Stutz automobiles. On tbat day be sold bis business, with all stock and fixtures on band, to appellee and plaintiff below, J. S. Gilliam. Tbe contract was in writing and tbe price agreed to be paid was tbe amount of tbe invoice of tbe stock, plus carriage, and a stipulated sum for two new Hupmobiles owned by plaintiff and wbicb were in bis garage, tbe total…
