The appellee, Hail, began this action against the appellant, Kentucky Title Company, in an effort to recover $1,779, which, Hail .alleged, was due him from the title company upon a title insurance contract, which he filed with his petition. • Hail recovered $1,014.54, and from that judgment the title company has appealed, and Hail has prosecuted a cross-appeal.
