The present proceeding is a wrongful death action arising out of an automobile accident in New York. The plaintiff, Irma Partman, administratrix of the estate of Karen Partman, the deceased, alleges that on March 15, 1990, her decedent was riding on the Taconic Parkway in New York as a passenger in a rented automobile owned by the defendant, Budget-Rent-A-Car of Westchester, Inc., doing business as Budget Rent-A-Car.
