This case involves a dispute between two insurance companies concerning their respective liabilities arising out of an automobile accident. It was tried before tbe court upon stipulated facts. Tbe plaintiff, Iowa National Mutual Insurance Company, insured Mrs. Warner Greene, the owner of a 1951 Packard automobile. Tbe defendant, Tbe Fidelity & Casualty Company of New York, insured her husband, Warner Greene, under a “nonowner policy,” wbicb policy was taken out and filed to provide proof of compliance witb tbe Financial Responsibility Law.
