(dissenting) : This is a case which in its circumstances and horrible and distressing consequences appeals most strongly to the sympathy of the Court; a bright, spirited boy, full of the buoyancy of youth, thoughtless of'danger, undertakes a too hazardous venture and comes to an untimely death.
