CEDARBURG, Chief Judge:

Appellant, charged with murder in violation of Article 118, Uniform Code of Military Justice (UCMJ), 10 U.S.C. § 918, was tried before a general court-martial composed of both officer and enlisted members held on 17,18 and 19 April and 2, 3, 9, 10, 11 and 19 May 1978. After both sides rested, arguments having been heard and instructions given, the court initially found the accused guilty, by substitutions and ex*813ceptions, of voluntary manslaughter in contravention of Article 119, UCMJ, 10 U.S.C. § 919.
