This is an information in the nature of a quo warranto filed by relator, who alleged that respondent usurps the office of justice of the peace in the city of Omaha.
Prior to the year 1885, under the provisions of section ■seven of chapter twenty-sis of the Compiled Statutes of 1881, each precinct in the state was entitled to two justices of the peace. Eelator held this office in precinct No. 2 of “the city of Omaha, and he alleges that at the general election in 1885 he was re-elected to said office for that precinct.
