James Constant appeals the order of the United States Claims Court, Constant v. United States, No. 295-88 C (Cl.Ct. Aug. 15, 1990), dismissing his motion, pursuant to Rule 60(b)(4) of the Rules of the United States Claims Court (RUSCC), to vacate that court’s previous dismissal of his complaint, Constant v. United States, No. 295-88 C (Cl.Ct. May 18, 1988), affd, 861 F.2d 728 (Fed.Cir.1988) (table), cert, denied, 488 U.S. 1007, 109 S.Ct. 789, 102 L.Ed.2d 781 (1989).
