We granted relator Home Savings Association leave to file its petition for writ of mandamus to determine whether respondent, Honorable Denzil Bevers, Judge of the 72nd Judicial District Court of Lubbock County, was required to sustain, or had the discretion to deny, relator's pleas in abatement. By the pleas, relator sought the abatement and dismissal, or the abatement and transfer to the 298th Judicial District Court of Dallas County, of two lawsuits pending in the Lubbock County District Court.
