The issue considered on this motion for summary judgment is whether an equitable distribution provision in a post-petition Judgment of Divorce based on a pre-petition Stipulation gives rise to a pre-petition claim which is discharged in the debtor’s Chapter 7 case, or a post-petition claim which is not discharged. The issue turns upon the fact that equitable distribution is in the nature of a distribution of property.
