In 1922 the Court of Appeals held invalid the then existing statute purporting to tax stock of national banks because it violated the prohibition of the United States Revised Statutes, section 5219, page 1009, as amended, against taxation of national bank shares at a greater rate than that imposed on other moneyed capital. People ex rel. Hanover Nat. Bank v. Goldfogle, 234 N. Y. 345.
