The plaintiffs, brother and sister, bring these actions to recover damages alleged to have been sustained by each when certain baggage owned by each was lost, destroyed or damaged while in the possession of the defendant.

The cases were tried before the court, a jury having been waived. It was stipulated at the commencement of the trial that the defendant is engaged in the steamship transportation of passengers; that on May 2, 1947, the plaintiffs, residents of Utica, New York, boarded the S.
