Earl Holland (defendant) appeals the denial of his Rule 24.035 motion without an evidentiary hearing. On appeal, defendant contends that the motion court erred in denying his motion because (1) the trial court, in accepting his plea of guilty, failed to inform him of the applicable mandatory minimum penalty and provided a mistaken and misleading statement regarding the minimum amount of time that he would serve under the trial court’s sentence, thereby violating Rule 24.02(b) and rendering his plea involuntary under the Fifth and Fourteenth Amendments of the…
