INTRODUCTION
This is a diversity action for involving a construction contract. Now before the Court is Defendant’s Motion to Dismiss the Amended Complaint [#22], pursuant to Rules 12(b)(6), 8(a)(2), and 8(e)(1) of the Federal Rules of Civil Procedure. Also before the Court is plaintiffs application for an order to show cause [# 35] why defendant should not be found in contempt for violating an earlier Order of the Court.
