In an action, inter alia, to recover damages for wrongful death, the defendants City of New York and New York City Police Department appeal, as limited by their brief, from so much of an order of the Supreme Court, Queens County (Plug, J.), dated December 18, 2002, as denied that branch of their cross motion *743which was for partial summary judgment dismissing so much of the complaint as sought to recover damages for negligent hiring and retention asserted against them.
Ordered that the order is reversed insofar as appealed from, on the law, with costs, that branch of the cross motion is granted,…
