I concur in the result reached by the majority on Zinn’s Title VII retaliation and state law whistleblowing claims, but disagree with the majority’s conclusion that Zinn failed to establish Kansas Department of Corrections (KDOC) could be her employer for purposes of these Title VII and state law claims. Zinn has made a sufficient showing of a dual' employer relationship to survive summary judgment.
