The record is voluminous and complicated because of the previous extensive litigation involved. The present suit is brought asking for judgment upon a $50,000 note (and upon other items not necessary to discuss separately on this appeal) and for foreclosure of a mortgage securing same; and also for a decree requiring defendant to reissue five hundred seventeen shares of its Class A stock formerly owned by plaintiff’s predecessor in interest (Phoenix Finance System, Inc.) but subsequently exchanged for bonds secured by the trust deed hereinafter referred to.
