OPINION OF THE COURT

2Per curiam

The defendant was found guilty upon a jury verdict of robbery in the second degree, assault in the second degree and criminal possession of stolen property in the second degree after trial upon a multiple-count indictment. A codefendant indicted and tried jointly with the defendant was acquitted on all counts submitted to the jury. The trial court granted the defendant’s motion to set aside the verdict with respect to the robbery and assault counts on the ground that the codefendant’s acquittal rendered the verdict of guilty as to those counts repugnant.
