SENTELLE, Circuit Judge.
Ramon Lopez appeals the District Court’s decision in which the court held that he was not entitled to certain documents related to a grand jury investigation under the Freedom of Information Act (“FOIA”). Specifically, the court held that the documents requested by Lopez fell within the third class of documents exempted from FOIA: documents protected by other statutes (in this case, documents covered by Rule 6(e) of the Federal Rules of Criminal Procedure).
