On December 16, 1904, plaintiffs in error executed and delivered to defendant in error a promissory note payable to the "order of defendant in error three years after date, for the principal sum of $30,045 with interest at 5% per annum. No part of said note was paid. On December 26, 1907, defendant in error brought this suit against the maters of said note and filed a declaration containing a special count upon the note and the common counts.
