MEMORANDUM OPINION

SCHATZ, District Judge.

This action involves a challenge to the Army Corps of Engineers construction of a proposed 4.5 mile long levee on the west bank of the Missouri River, immediately south of Bellevue, Nebraska, to be constructed as Unit R-616 of the Missouri River Levee System. Plaintiff, Watershed Associates Rescue (WAR) is an unincorporated association of landowners, lessees and other persons interested in and affected by the proposed levee.
