MEMORANDUM OPINION

JOHN H. PRATT, Judge.

This ease is currently before the Court on parties’ cross motions for summary judgment. Since there is no genuine dispute as to the facts material to the disposition of this case, summary judgment is appropriate. For the reasons set forth below, we grant defendants’ motion for summary judgment.
