PROCEDURAL HISTORY

This case, before the court after trial, originally was filed in the United States District Court for the Eastern District of California in 1983 and was transferred to the United States Court of Federal Claims on April 1, *3242004, as a takings claim.1 On April 20, 2004, plaintiffs amended the complaint to include a breach of contract claim.2 Defendant filed a motion to dismiss on June 21, 2004, which was denied on September 3, 2004.
