Plaintiff Nicholas Zirogiannis (“Plaintiff’ or “Zirogiannis”) commenced this action against Defendant Seterus, Inc. (“Defendant” or “Seterus”), individually and on behalf of a class, seeking to recover for Defendant’s alleged violation of the Fair Debt Collection Practices Act (“FDCPA”), 15 U.S.C. § 1692 et seq. See Docket Entry (“DE”) [1], Presently before the Court is Seterus’s motion to dismiss Plaintiffs Amended Complaint pursuant to Rules 12(b)(1) and 12(b)(6) of the Federal Rules of Civil Procedure, which Plaintiff opposes.
