OPINION
GARRITY, District Judge.
Earlier in this litigation, and upon mandate of the Court of Appeals for the First Circuit, 428 F.2d 191, reversing and remanding this court’s decision, 303 F.Supp. 1220, we ordered a preliminary injunction enjoining the defendant Honeywell from distributing certain advertising brochures pertaining to defendant’s safety control replacement system for industrial heating units. Remaining before us for disposition are plaintiff’s claims under both the Lanham Act, 15 U.S.C. § 1125(a), and the common law of unfair competition, for damages, punitive damages,…
