Before the court are three motions, two that the plaintiffs filed in this case and one that the defendant filed. First, on August 2, 1999, the defendant filed a “Motion for Summary Judgment” in accordance with Federal Rule of Civil Procedure 56(b), on both claims found in the plaintiffs’ complaint. Second, also on August 2,1999, the plaintiffs filed a “Motion for Declaratory Judgment,” which this court construes as a motion for partial summary judgment.
