J. P. Orda stands indicted for the crimes of sodomy in the first degree (Penal Law § 130.50 [1]) and sexual abuse in the first degree (Penal Law § 130.65 [1]). At the conclusion of the People’s case (at which point the court reserved decision), and again upon completion of the entire case, on the ground that the evidence presented is not legally sufficient to establish either of the offenses charged against him, Mr. Orda seeks a trial order dismissing the indictment (CPL 290.10).
