On May 23, 2013, appellant Kevin Mack was charged by indictment with two counts of distribution of a mixture or substance containing phencyclidine (PCP), in violation of 21 U.S.C. § 841(a)(1), (b)(l)(B)(iv), (b)(1)(C), for twice selling PCP to an undercover police officer. On July 21, 2014, appellant pled guilty to one count of the indictment. On July 28, 2015, the District Court imposed a 77-month term of incarceration and 36 months of supervised release.
