This case is before the court on petition of the National Labor Relations Board for enforcement of its order that Osborn Transportation, Inc. (the company) bargain collectively with a Teamster’s local union (the union) certified by the Board after a representation election as the exclusive representative of certain of the company s employees. 1 The company, as respondent, argues principally that preelection conduct by the Board agent who conducted the election gave the appearance of favoring the union thus prejudicing the outcome of the election.
