SATHRE, Judge.

The plaintiff brings this action against the defendant to recover commissions claimed to be earned for the preparation of plans and specifications and supervision of the construction of a building belonging to the defendant located at Bismarck, North Dakota, known as the Admiral Hotel. The complaint alleges that the plaintiff is an architect and during the month of April 1948 he entered into an oral agreement with the defendant by the terms of which the plaintiff agreed to draw plans and specifications for a hotel building known as the Admiral Hotel located on lot 19, block 44,…
