Defendant appeals a judgment of the Eleventh Judicial District Court, Flathead County, entered in favor of plaintiffs for the sum of $38,930.86. We reverse and remand for a new trial.

Plaintiffs instituted this action against defendant to recover damages for breach of an agreement by defendant to pay plaintiffs for services performed in connection with real estate sales. In addition to breach of contract, plaintiffs included a claim for fraud and asked for an accounting.
