— In this action the appellee sued the appellant and Mrs'. Samuel Cole, “ Avhose first name is otherwise unknown to plaintiff,” in a complaint of two paragraphs. In the first paragraph of his complaint the appellee alleged, in substance, that on or about the 3d day of July, 1863, one Alvah Benedict, a citizen and resident of Monroe county, New York, was the owner in fee-simple of the real estate in Elkhart county, Indiana, described as the west half of the north-east quarter and the east half of the uortliAvest quarter, and the south-west quarter of the north-west ■ quarter, of section 26, in…
