William E. Cloyes and his wife were killed in a collision between their automobile and a truck owned by Lonnie Powell, dba Powell Farms, and driven by his employee, Melvin C. Johnson, in Webster County on April 14, 1956. The truck was being operated under a “lease agreement” with Harper Motor Lines, hereinafter Harper. Actions for the wrongful death of Mr. and Mrs. Cloyes against the three parties were settled by Harper’s liability insurer, the appellant, American Fidelity and Casualty Company, for $12,500.
