ROBERT L. TAYLOR, Chief Judge.

There are two motions for consideration. The first is the motion of Atlantic Truck Lines, Inc., hereafter for convenience called Atlantic, for a judgment notwithstanding the verdict of the jury. The second is that of defendants, Earl B. Turner, Jr. and Atlantic, for a new trial.

In support of the motion for judgment notwithstanding the verdict it is asserted that at the time of the accident out of which the action arose the tractor-trailer unit involved in the accident was neither owned nor operated by Atlantic but was being operated by the defendant,…
