I. Factual Background

On April 21, 1980, Stephen C. Crane was arrested at his office and jailed pursuant to a misdemeanor capias alleging that he knowingly exhibited obscene film at the Crystal Adult Theater in Dallas. It later developed that Crane was arrested only because a lawyer with whom Crane shares office space listed him, without his knowledge or consent, as one of three “initial directors” in the 1979 Articles of Incorporation of a Texas corporation known as the Crystal Theater.
