OPINION

MACKEY K. HANCOCK, Justice.

Appellant, Daniel Anacleto Cardón, was convicted of the offense of capital murder. 1 The State did not seek the death penalty and, accordingly, appellant was sentenced to confinement in the Institutional Division of the Texas Department of Criminal Justice for life without parole. 2 Appellant appeals his conviction, alleging that the trial court committed error in the charge to the jury in two particulars.
