The question for determination in this appeal is whether the contract giving rise to the litigation violated the rule against perpetuities and therefore was void.

The Ryland Group, Inc. (Ryland), filed a motion for judgment in the trial court against P. Reed Wills as trustee, P. Reed Wills and Joanne T. Wills individually, and Wills Investment, Inc. (collectively, the Wills), and Capital Homes, Inc. (Capital).
