1. INTRODUCTION

Plaintiffs have brought a class action lawsuit seeking relief for alleged constitutional violations by a unit of the New York City Police Department (“NYPD”) known as the Street Crime Unit (the “SCU”).1 It is alleged that in high crime areas, SCU officers have conducted suspicionless stops and frisks, relying on impermissible considerations of race and/or national origin rather than the “reasonable articulable suspicion” required by Fourth Amendment jurisprudence.
