In an action, inter alia, to recover damages for medical malpractice and wrongful death, etc., the defendant appeals from an order of the Supreme Court, Nassau County (Martin, J.), dated March 16, 2006, which denied his motion to dismiss the complaint pursuant to CELR 3211 (a) (5) as barred by the statute of limitations.
Ordered that the order is reversed, on the law, with costs, and the defendant’s motion to dismiss the complaint is granted.
