This is a motion to vacate and set' aside an execution issued herein to the sheriff of the county of New York on the 2d day of November, 1907, and to cancel and discharge of record a notice filed herein in the office of the clerk of New York county on the 2d day of November, 1907, under section 1252 of the Code of Civil Procedure, by the sheriff of New York county.
