The plaintiff, on behalf of the Secretary of the Department of Housing and Urban Development (“HUD”), brought suit under 12 U.S.C. § 1715z-4a to recover misappropriated funds and damages resulting from the improper use of assets and income derived from Mill Pond Village, a multifamily housing complex located in Connecticut and whose mortgage is insured by HUD under Title II of the National Housing Act.
