This matter is before the Court on cross motions for summary judgment filed by plaintiff State Farm Fire and Casualty Company (“State Farm”) and defendants Nationwide Mutual Insurance Company and Nationwide Mutual Fire Insurance Company (collectively “Nationwide”). Docs. 13 and 16. This case arises out of a traffic accident, in which a pedestrian was injured as a result of the driver’s negli gence.
